DW Property B.V. ("DW Property") en haar dochterondernemingen respecteren uw privacy. Wij verwerken je persoonsgegevens zorgvuldig en in overeenstemming met de wet. In onze Privacyverklaring leggen we uit welke gegevens we gebruiken en hoe we deze gegevens opslaan, beschermen en verwerken. Deze Privacyverklaring is van toepassing op de activiteiten van alle bedrijven die deel uitmaken van de DW Property Groep, waaronder RW Metterswane Nijmegen B.V., en partij zijn bij de Intra-Group Data Protection Agreement.
2. Verwerking van persoonlijke gegevens
DW Property vindt het belangrijk om u te informeren over hoe het met uw persoonlijke gegevens omgaat, wat het gebruik van deze gegevens betekent en uw rechten in dit verband. Bij de verwerking van persoonsgegevens houdt DW Property zich aan een strikt privacy beleid. 3. Persoonlijke gegevens – Property Website bezoekers

d) Financiële gerelateerde gegevens: door u verstrekte gegevens over uw financiële situatie die relevant zijn voor het uitvoeren van een huurderscontrole met betrekking tot huurnormen (inclusief inkomen, vermogen en andere financiële verplichtingen, inclusief type dienstverband of gegevens van uw bedrijf, beroep en/of functietitel, uitkering(en), pensioen(en), vermogen, enz.)
e) Gegevens van sociale media betekent uw profielgegevens op sociale media zoals LinkedIn en andere informatie die u openbaar maakt op of anderszins met ons deelt via sociale media.
f) Marketingcommunicatiegegevens zijn gegevens over hoe u reageert op e-mail, SMS, Whats app, telefoon en andere marketingcampagnes.
g) Feedbackgegevens betekent uw feedback over ons en onze diensten of (te bouwen) eigendommen en hun omgeving via onze tevredenheidsenquêtes of via een andere manier van communicatie, feedback en antwoorden op enquêtes.
h) Technische Gegevens internet protocol (IP) adres van waaruit u toegang heeft tot het Portaal en onze of andere producten en diensten, cookies (zoals uiteengezet in ons Cookiesbeleid, uw inloggegevens (zoals de tijd, datum en duur), het browsertype en de browserversie die u gebruikt om toegang te krijgen tot het Portaal en onze of andere websites, apps en producten en diensten, weblogs, verkeersgegevens, tijdzone-instellingen van uw apparaat en de locatie daarvan, browser plug-in types en versies die u gebruikt, andere communicatiegegevens, bronnen waartoe u toegang hebt op het Portaal, onze apps, websites, producten en diensten, het besturingssysteem en platformtype van het apparaat dat u gebruikt, en details van andere technologie op de apparaten die u gebruikt om toegang te krijgen tot het Portaal of onze websites, apps, producten of diensten.
4. Doeleinden van de verwerking van persoonsgegevens
DW Property verwerkt uw persoonsgegevens tijdens de volgende activiteiten:
• Om communicatie te versturen bij de uitvoering van onze diensten en voor marketingdoeleinden, zoals e-mails, aankondigingen, nieuwsbrieven.
• Om met u een overeenkomst aan te gaan.

5. Gronden voor de verwerking van persoonsgegevens
Om persoonlijke gegevens te kunnen gebruiken, zal daartoe een grondslag moeten bestaan onder de AVG. We gebruiken de volgende gronden:
• de persoonsgegevens moeten worden gebruikt om een overeenkomst met u uit te voeren of aan te gaan;
• de persoonlijke gegevens moeten worden gebruikt om aan een wettelijke verplichting te voldoen;
• in noodsituaties: de persoonsgegevens moeten worden gebruikt om een vitaal belang van u of iemand anders te beschermen;
• we een legitiem belang hebben om de persoonsgegevens te gebruiken, tenzij dit zwaarder weegt dan uw belang of het belang van een derde partij bij privacy;
• u expliciet toestemming hebt gegeven aan ons.
DW Property kan zich beroepen op de volgende legitieme belangen:
• onderhoud en (duurzaamheids-) verbeteringen aan het eigendom en de installaties;
• de bescherming van uw veiligheid, de veiligheid van derden, de gebouwen en eigendommen die toebehoren aan DW Property;
• voor kwaliteits- en trainingsdoeleinden.
• om IT-beheer te bevorderen en de beveiliging te verbeteren;
• om de diensten en inhoud van onze websites te analyseren en te verbeteren;
• om onze diensten te leveren, te verbeteren, aan te passen, te ondersteunen, te onderzoeken en te analyseren;
• om de kwaliteit en veiligheid van de diensten die we leveren te bevorderen;
• om met u en andere zakelijke partners van DW Property te communiceren;
• om fraude, ongeoorloofd gebruik en overtredingen van onze beleidsregels of andere schadelijke of illegale activiteiten te voorkomen en te bestrijden.
6. Delen van persoonlijke gegevens - Property Website bezoekers
Voor het uitvoeren van de hierboven beschreven activiteiten kan DW Property derden inschakelen, waaronder leveranciers (onder andere voor keuken en sanitair), energieleveranciers, vastgoedbeheerders, verkoopmakelaars, IT-serviceproviders, websiteleveranciers en marketingbureaus, advocaten, notarissen en gerechtelijke instanties.
Wanneer deze derden uw persoonsgegevens verwerken en niet aangemerkt worden als verwerking verantwoordelijke in de uitvoering van de respectieve activiteiten, zal DW Property de vereiste contractuele, technische en organisatorische maatregelen nemen om ervoor te zorgen dat uw persoonsgegevens uitsluitend worden verwerkt voor zover dit vereist is voor de uit te voeren activiteiten en in overeenstemming met de toepasselijke wet- en regelgeving. DW Property zal met derden aangemerkt als verwerkers, naast de bovengenoemde overeenkomsten, ook een verwerkingsovereenkomst aangaan om een gepaste wijze van verwerking door de derde van de door DW Property verstrekte persoonsgegevens te kunnen waarborgen.
Als DW Property hiertoe wettelijk verplicht is, kunnen uw persoonlijke gegevens ook worden gedeeld met de overheid zulks niet beperkt tot de belastingdienst, wetshandhavingsinstanties (de politie en/of het Openbaar Ministerie), toezichthoudende autoriteiten (De Nederlandsche Bank, de Autoriteit Financiële Markten en/of het College Bescherming Persoonsgegevens.)
7. Delen van persoonlijke gegevens buiten de Europese Economische Ruimte
Soms moeten we uw persoonlijke gegevens doorgeven aan derden buiten de Europese Economische Ruimte (EER). In overeenstemming met de AVG, zal DW Property uw persoonlijke gegevens alleen doorgeven naar landen buiten de EER:
• als de Europese Commissie heeft besloten dat het derde land een passend beschermingsniveau garandeert;
• als passende maatregelen worden aangeboden en u afdwingbare rechten hebt en over effectieve verhaalmiddelen beschikt;
• de overdracht noodzakelijk is voor de uitvoering van uw overeenkomst met DW Property;
• als u uitdrukkelijk hebt ingestemd met de overdracht, na te zijn geïnformeerd over de risico's van de overdracht;
• als de overplaatsing noodzakelijk is om ernstige redenen van algemeen belang;
• indien de doorgifte ad hoc en noodzakelijk is voor de dwingende belangen van DW Property, DW Property passende waarborgen heeft getroffen en het College Bescherming Persoonsgegevens naar behoren is geïnformeerd.
In situaties waarin DW Property uw persoonsgegevens doorgeeft buiten de EER, nemen we maatregelen zoals het beveiligen van de verwerking en procedures in de vorm van een verwerkersovereenkomst met de betreffende derde partij, om ervoor te zorgen dat uw persoonsgegevens goed beschermd blijven.
8. Beveiliging
Om uw persoonsgegevens zo goed mogelijk te beschermen, neemt DW Property passende technische en organisatorische maatregelen om misbruik, verlies, onbevoegde toegang of enige andere vorm van onrechtmatige verwerking tegen te gaan. Deze maatregelen bestaan onder andere uit beveiligde servers, ons privacy beleid en training van medewerkers. Medewerkers van DW Property die toegang hebben tot uw persoonsgegevens hebben een geheimhoudingsplicht en hebben alleen toegang tot uw persoonsgegevens als dit noodzakelijk is voor de uitoefening van hun functie.
9. Bewaartermijn
DW Property bewaart uw persoonsgegevens zo lang als nodig is en in overeenstemming met de toepasselijke
wet- en regelgeving voor de uitvoering van overeenkomsten, om diensten te kunnen verlenen, om u in staat te stellen om de websites te gebruiken, om te kunnen voldoen aan toepasselijke wetgeving, geschillen met partijen te beslechten en anderszins voor zover dit noodzakelijk is om ons in staat te stellen onze bedrijfsactiviteiten uit te voeren.
DW Property bewaart uw persoonsgegevens in alle gevallen voor de periode waarin u een overeenkomst heeft met DW Property. Voor bepaalde persoonsgegevens geldt een wettelijke bewaartermijn waardoor DW Property verplicht is om gegevens te bewaren na afloop van een overeenkomst. DW Property zal voldoen aan de voorschriften betreffende wettelijke bewaartermijnen.
Bij afwezigheid van enige vorm van overeenkomst, toestemming of andere wettelijke grond, bewaart DW Property de gegevens maximaal vier weken, tenzij deze langer bewaard moeten worden in verband met een incident.
10. Cookies en soortgelijke technologieën
DW Property maakt op haar websites gebruik van cookies en soortgelijke technologieën. Cookies zijn kleine stukjes informatie die op uw computer worden opgeslagen. Wij gebruiken cookies voor het functioneren en leveren van onze diensten. Cookies stellen DW Property in staat om te zien welke bezoekers gebruik maken van haar website. Ze stellen DW Property in staat haar websites aan te passen aan de voorkeuren van de gebruiker. Deze kleine stukjes informatie worden bij een volgend bezoek aan de websites van DW Property herkend.
Onze website en/of dienst heeft niet de intentie gegevens te verzamelen over websitebezoekers die jonger zijn dan 16 jaar, tenzij ze toestemming hebben van hun ouders of voogd. Het kan zijn dat DW Property uw identiteit moet verifiëren voordat zij aan uw verzoek kan voldoen.
DW Property zal zo snel mogelijk, maar binnen maximaal vier weken, op uw verzoek reageren. Uw
verzoeken worden in principe elektronisch afgehandeld, tenzij dit niet mogelijk is of als u anderszins verzoekt.
Als we uw verzoek afwijzen, zullen we de redenen hiervoor geven en uw verzoek zal niet anders worden behandeld dan in overeenstemming met de huidige wet- en regelgeving.
11.1.Rechten van betrokkenen
Uw verzoek kan betrekking hebben op een of meer van de volgende rechten die u bezit:
Recht op toegang tot persoonlijke gegevens
U kunt te allen tijde verzoeken dat wij u informeren over de categorieën persoonsgegevens die DW Property over u verwerkt, de redenen voor de verwerking van die gegevens, de bron waaruit de gegevens afkomstig zijn en de bewaartermijnen die in acht worden genomen.
Recht om persoonlijke gegevens te wijzigen
U kunt te allen tijde contact met ons opnemen om uw persoonsgegevens aan te vullen of te corrigeren. Als DW Property onverhoopt onterecht persoonsgegevens van u heeft verwerkt en/of aan derden heeft verstrekt, zal DW Property dit onverwijld corrigeren. Als DW Property uw persoonsgegevens heeft gewijzigd, zal DW Property u hiervan op de hoogte stellen.
Recht om de verwerking van uw persoonlijke gegevens te beperken
Als u het niet eens bent met de inhoud van de persoonsgegevens die DW Property over u bewaart, kunt u in sommige gevallen een verzoek indienen om de verwerking van uw persoonsgegevens tijdelijk te beperken.
Recht om toestemming in te trekken
De toestemming die u heeft gegeven voor de verwerking van uw persoonsgegevens kunt u intrekken. Zodra DW Property uw brief of e-mail heeft ontvangen, zal zij de verwerking van uw persoonsgegevens waarvoor u toestemming heeft gegeven onmiddellijk opschorten. Het intrekken van de toestemming heeft echter geen invloed op de verwerking die al heeft plaatsgevonden.
Recht op overdracht van persoonlijke gegevens (recht op gegevensoverdraagbaarheid)
U kunt de persoonlijke gegevens die DW Property over u bewaart opvragen in een leesbaar en toegankelijk format. Zodra u uw persoonlijke gegevens heeft ontvangen, bent u vrij om deze gegevens over te dragen.
Recht om vergeten te worden
Als u niet langer gebruik wenst te maken van de diensten van DW Property, kunt u ons verzoeken om al uw persoonlijke gegevens te verwijderen.
Recht op bezwaar
U heeft het recht om bezwaar te maken tegen de verwerking van uw persoonsgegevens door DW Property die is gebaseerd op de gronden 'gerechtvaardigd belang of een belang van DW Property of een derde' en 'het uitvoeren van een taak van algemeen belang'. Als DW Property zich op deze gronden beroept, zal DW Property deze belangen afwegen ten opzichte van uw privacy. Where these third parties process your personal data during the performance of the respective activities, DW Property will take the required contractual, technical, and organisational measures to ensure that your personal data is solely processed to the extent that this is required for the activities to be performed and in accordance with the applicable laws and regulations.
If DW Property is legally required to do so, your personal data may also be shared with the authorities, not restricted to tax authorities, law enforcement agencies (the police and/or the Public Prosecution Service), supervisory authorities (the Dutch central bank (De Nederlandsche Bank), the Netherlands Authority for the Financial Markets) and/or the Dutch Data Protection Authority
Sharing of personal data outside of the European economic area
We may occasionally need to transfer your personal data to third parties located outside of the European
Economic Area (EEA). In accordance with the GDPR, DW Property will only transfer your personal data to countries outside of the EEA:
if the European Commission has ruled that the third country guarantees a suitable level of protection;
if appropriate measures are offered and you have enforceable rights and have effective means of redress.
the transfer is necessary for the performance of your agreement with DW Property;
if you have expressly consented to the transfer, after having been informed of the risks associated with the transfer;
if the transfer is necessary due to serious reasons of general importance;
if the transfer is ad hoc and necessary for DW Property’s compelling interests, DW Property has taken appropriate safeguards, and the Dutch Data Protection Authority has been duly informed.
In situations where DW Property transfers your personal data outside of the EEA, we take measures such as safeguarding the processing and procedures in the form of a processing agreement with the respective third party, to ensure that your personal data remains properly protected.
Security
To protect your personal data in the best manner possible, DW Property takes appropriate technical and organisational measures to combat misuse, loss, unauthorised access, or any other form of unlawful processing. These measures include secured servers, our privacy policy, and employee training. Employees of DW Property who can access your personal data are under an obligation to maintain confidentiality and solely have access to your personal data if this is necessary for the performance of their role.
Retention period
DW Property retains your personal data for as long as is necessary and in accordance with the applicable
laws and regulations for the performance of agreements, to be able to provide services, to enable you to
use the websites, to be able to comply with applicable legislation, settle disputes with parties, and otherwise in so far as this is necessary to enable us to perform our business activities.
DW Property retains your personal data in all cases for the period in which you have an agreement with DW Property. A statutory retention period applies to certain personal data which means that DW Property is also required to retain data after the end of an agreement. DW Property fully complies with this statutory retention period. In the absence of any form of agreement, consent, or other statutory ground, DW Property will retain the data for a maximum of four weeks, unless it needs to be retained for longer in connection with an incident.

DW Property uses cookies and similar technologies on its websites. Cookies are small pieces of information that are stored on your computer. We use cookies for the functioning and provision of our services. Cookies enable DW Property to see which visitors use its website. They allow DW Property to adapt its websites to user preferences. Our website and/or service does not intend to collect data on website visitors who are under 16 years of age. Unless they have parental or guardian consent. However, we cannot verify whether a visitor is older than 16. If your personal data is processed, you have several rights, which are explained below. You can exercise these rights by submitting a request in writing to DW Property or by emailing: rv.privacy@dwproperty.com. DW Property may have to verify your identity before it can comply with your request.
DW Property will respond to your request as soon as possible. Your requests will be handled electronically, in principle, unless this is not possible or if you request otherwise. If we reject your request, we will provide the reasons for this, and your request will not be handled other than in accordance with the current laws and regulations.

You request may concern one or more of the following rights that you possess:
Right to access personal data
You may request at any time that we inform you of the categories of personal data about you that DW Property processes, the reasons for processing that data, the source from which the data originates, and the retention periods that are being observed.
Right to change personal data
You can contact us at any time to add to or correct your personal data. If DW Property has unexpectedly processed personal data about you and/or has provided this to third parties, DW Property will immediately correct this. If DW Property has amended your personal data, DW Property will notify you.
Right to restrict processing of your personal data
If you disagree with the content of the personal data that DW Property retains about you, in some cases you may submit a request to temporarily restrict the processing of your personal data.
Right to withdraw consent
You can also withdraw the consent you have given for processing your personal data. Once DW Property has received your letter or email, it will immediately suspend the processing of your personal data. However, the withdrawal of consent does not affect processing that has already taken place.
Right to transfer personal data (right to data portability)
You may request the personal data that DW Property holds about you in a structured, accessible, and machine-readable format. Once you have received your personal data, you are free to transfer this data.
Right to be forgotten
If you no longer wish to use DW Property’s services, you can request that we delete all your personal data.
Right to object
You have the right to object to the processing of your personal data by DW Property that is based on the grounds of a ‘legitimate interest or an interest of DW Property or a third party’ and ‘performing a task of general importance’. If DW Property relies upon these grounds, DW Property will weigh up these interests regarding your privacy. The right to object enables you to request that DW Property weighs up these interests once again.
You also have the right to file a complaint to the supervisory authority.

Amendments and applicable law
DW Property retains the right to unilaterally amend this Privacy Statement and to inform you in an appropriate manner where necessary. None of the provisions in this Privacy Statement are intended to create an obligation or agreement between DW Property and you.
